Returns, Refunds & Australian Consumer Law
Your Rights Under Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if they fail to meet an applicable consumer guarantee and the failure does not amount to a major failure.
Nothing in this policy excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law.
Custom-Made Products
All Spartan Guards night guards are custom manufactured from impressions of your teeth and are made specifically for you. As they are personalised medical devices, they cannot be resold or reused.
For this reason, we do not accept returns or provide refunds simply because you:
-
change your mind;
-
decide you no longer wish to use the appliance;
-
prefer a different style or thickness;
-
expected a different feel or sensation;
-
find the adjustment period unsuitable; or
-
no longer require the product.
Fit, Comfort or Manufacturing Concerns
If you experience any issues with the fit, comfort or function of your night guard, please contact us as soon as possible.
Most fit or comfort concerns can be resolved through minor adjustments or, where appropriate, a remake of the appliance. We may ask you to provide photographs or return the appliance to our laboratory for assessment before determining the most appropriate remedy.
Where a manufacturing defect or issue covered by the Australian Consumer Law is identified, we will repair, replace or refund the product as required by law.
Assessment of Returned Products
If a product is returned because you believe it is faulty, defective or does not comply with the Australian Consumer Law, we must be given a reasonable opportunity to inspect and assess the product before determining the appropriate remedy.
Products should not be modified, altered or damaged after the issue is identified, as this may affect our ability to assess the claim.
Return Shipping
Unless required by the Australian Consumer Law, customers are responsible for the cost of returning products to our laboratory.
Where a refund is provided under the Australian Consumer Law because of a major failure, any applicable delivery charges paid by the customer will also be refunded where required by law.
How to Make a Return Request
Please contact us before returning any product. We will provide instructions for returning the appliance and advise whether any additional information is required to assess your claim.
